Welcome to PixelAcademy, the online photography and photo editing course platform of MoreThanWords BV ("we," "our," or "us"). These Terms & Conditions govern your access to and use of our website at pixelacademy.ezycourse.com, pixelacademy.photo, and pixelacademy.be and our online courses, digital content, and related services (collectively, the "Services"). By accessing the Services or enrolling in a course, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use the Services.

1. Acceptance of Terms

By creating an account, purchasing a course, or otherwise using the Services, you confirm that you have read, understood, and agree to these Terms & Conditions and any policies referenced in them.

2. Eligibility

You must be at least 18 years old to purchase or enroll in our courses. If you are enrolling on behalf of a minor, you represent that you are their parent or legal guardian and accept these Terms on their behalf.

3. Account Registration

• You must create an account to enroll in courses or access content.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You agree to provide accurate, current, and complete information when registering, and to keep it updated.
• Accounts are personal to you and may not be shared, transferred, or used by more than one person.

4. Course Enrollment & Access

• Upon successful payment, you will receive access to the purchased course(s) for the duration specified at the time of purchase (e.g., lifetime access, 12 months, or a fixed cohort period).
• We reserve the right to update, revise, or discontinue course content to keep it current, provided this does not materially reduce the value of a course you've already purchased.
• Access may be suspended or revoked if these Terms are violated, including unauthorized sharing of login credentials or course materials. Suspension or revocation for a violation of these Terms does not entitle you to a refund.
• Technical requirements (device, internet connection, software) are the responsibility of the student.

5. Payments, Pricing & Refunds

• All fees must be paid in full through the payment methods offered at checkout. Payments are processed by a third-party payment processor, and we are not responsible for errors or outages on their end.
• Prices are listed in EUR or USD, depending on the course's primary target market, and may change at any time; changes will not affect courses already purchased.
• Refund Policy: Refunds are available within 14 days of purchase. To request a refund, contact us at [email protected].
• Subscriptions, payment plans, or installment options (if offered) will auto-renew or continue billing until cancelled by the student, in accordance with the terms shown at checkout.

6. Intellectual Property & Content Use

• All course materials — videos, text, worksheets, templates, images, quizzes, and downloads — are the property of MoreThanWords BV or its licensors and are protected by copyright and other intellectual property laws.
• Your enrollment grants you a personal, non-transferable, non-exclusive license to access and use course materials for your own learning. You may not:
• • Reproduce, redistribute, resell, or publicly share course content;
  • Record, download, or repost video lessons outside the platform without written permission;
  • Use course materials to create a competing product or service.
• Any work, projects, or content you submit within the course (e.g., assignments, forum posts) remains yours, but you grant us a license to use it for course delivery, feedback, and promotional purposes unless you opt out in writing.
• Where exercise files (e.g., practice images, RAW files, templates) are provided as part of a course, they may only be used as practice material for that specific course. You may not publish or post exercise files or the results of your edits to them on social media or elsewhere, claim them as your own original work, or submit them to competitions.
• Where course downloads are available, they are provided solely to facilitate offline viewing for your personal use. You may not share downloaded course content with others or upload, post, or distribute it on any website, platform, or file-sharing service.

7. Acceptable Use

You agree not to:

• Violate any applicable law or regulation while using the Services;
• Share your account or course access with others;
• Attempt to circumvent access restrictions, download protections, or payment requirements;
• Post abusive, offensive, or infringing content in course discussions, forums, or reviews;
• Attempt to gain unauthorized access to our systems, other users' accounts, or course platform infrastructure.

8. Student Conduct & Community Guidelines

If courses include community features (forums, live sessions, group chats), you agree to engage respectfully. We reserve the right to remove content or restrict access for participants who violate community guidelines, harass other students, or disrupt the learning environment.

9. Disclaimers

• The Services and all course content are provided "as is" and "as available," without warranties of any kind, express or implied.
• We do not guarantee specific outcomes, results, or income from completing a course. Results depend on individual effort, skill, and circumstances.
• We do not guarantee the Services will be uninterrupted, error-free, or secure at all times.
• We are not responsible for third-party tools, links, or content referenced within courses.

10. Limitation of Liability

To the maximum extent permitted by law, MoreThanWords BV shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Services, even if advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid for the course giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless MoreThanWords BV, its officers, employees, and affiliates from any claims, damages, or expenses arising from your use of the Services, violation of these Terms, or infringement of any third party's rights.

12. Termination

We may suspend or terminate your account and access to course content at our discretion, without refund, if you violate these Terms, engage in fraudulent activity, or misuse course materials. You may also close your account at any time by contacting us. Closing your account does not entitle you to a refund, except for courses purchased within the 15 days prior to your termination request, which remain subject to the refund policy above.

13. Privacy & Data Protection

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data, in compliance with the EU General Data Protection Regulation (GDPR).

14. Changes to These Terms

We may update these Terms & Conditions from time to time. The revised version will be posted here with an updated effective date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law & Disputes

These Terms are governed by the laws of Belgium, without regard to conflict-of-law principles. Any disputes arising from these Terms shall be submitted to the exclusive jurisdiction of the courts of Ghent, Belgium.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
